There is a financial cost and emotional cost inherent in being a party to any court proceedings.

Fortunately, Family Dispute Resolution is an alternative option available to you and can be very effective in resolving family law matters.

Family Dispute Resolution is a gentle approach to reaching an agreement for property settlement and living arrangements for children.

The process is confidential and should you not reach an agreement, matters discussed during Family Dispute Resolution cannot be used against you in court.

In short, Family Dispute Resolution is a process that involves a Family Dispute Resolution Practitioner (also known as a Mediator), who will assist you and your ex-partner in working through the issues that are most important to each of you, such as:

  • How will the assets between you be separated?
  • How will debts between you be finalised?
  • What will parenting of your children look like?
  • Who will the children live with and spend time with? and
  • Who will take on the responsibility of any pets that were a part of the family?

The role of the Family Dispute Resolution Practitioner is to take a non-biased approach through an initial consult with each of you and then a joint meeting.

The Practitioner listens to the needs of each of you and assists each of you in resolving some (if not all) of the disputes between you.

 

The Importance of Family Dispute Resolution

 

Whilst there are costs associated with Family Dispute Resolution, it is a more cost-effective way to settle all outstanding matters between you and your ex-partner than to initiate proceedings in the Court.

The time involved is usually significantly less than Court proceedings and, depending on the complexity of the matters between you, may take as little as a few hours or across a few days, whereas Court proceedings may take more than 12 months.

The Family Dispute Resolution process allows you and your ex-partner to be the decision-makers and have control over the situation.

It is a less stressful way of resolving issues and the process can end in a more positive relationship between you and your ex-partner.

 

How will the Agreement be finalised?

 

Family Dispute Resolution aims to reach an agreement on the outstanding issues in dispute between you.

Once you have agreed on those issues in dispute, you can document the agreed terms reached by way of a financial and/or parenting plan or by way of Consent Orders.

A financial/parenting plan is a less formal document that is prepared by the Family Practitioner and signed by each of you.

A Consent Order is a formal document that is signed by each of you and filed with the Court.
